By accessing the Site, requesting a sample, submitting an inquiry, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or the Services.

1. About Sukarta

Sukarta products are natural stone. By requesting or ordering any Sukarta product, you acknowledge and agree that:

  • Every piece of natural stone is unique. Color, tone, veining, texture, mineral variation, and finish will differ from tile to tile, from batch to batch, and from samples to production material.
  • The samples we provide are indicative only. They are intended to show the general character of a material, not to represent the exact appearance of any specific tile in a production order.
  • Natural variation is not a defect. It is a defining characteristic of the material and is not grounds for return, refund, or replacement.
  • Photographs and imagery on the Site are representative. On-screen color depends on your device and lighting conditions, and may not accurately reflect the material in person.
  • Some minor imperfections — including but not limited to natural pitting, faint fissures, or mineral spotting — are inherent to the material and are considered acceptable characteristics of natural stone.

We strongly recommend reviewing physical samples and, for larger projects, requesting a control slab or additional samples from the specific production batch before installation.

3. Samples

Sample kits and individual samples may be ordered through the Site or by request.

  • Sample kits are non-refundable.
  • Samples are provided for evaluation only and may not accurately represent the color, tone, or texture of a full production order.
  • Samples remain the property of the requester once shipped; return of samples is not required.
  • We reserve the right to limit sample quantities, decline sample requests, or charge for samples at our discretion.

4. Orders, Quotes, and Custom Dimensions

4.1 Quotes

Written quotes provided by Sukarta are valid for the period stated on the quote and are subject to material availability at the time of order confirmation. Quotes do not constitute a binding sale until confirmed in writing and paid in accordance with Section 5.

4.2 Order Confirmation

All orders are subject to acceptance by Sukarta. An order is considered confirmed only when Sukarta has issued a written order confirmation and received the applicable deposit or payment.

4.3 Custom Dimensions and Made-to-Order Products

Custom dimensions, finishes, and formats are available upon request and are produced to order.

  • Custom orders are non-cancellable, non-returnable, and non-refundable once production has begun.
  • Lead times for custom orders may exceed standard lead times and will be quoted individually.
  • Custom orders may require a non-refundable deposit at the time of order confirmation.

5. Pricing, Taxes, and Payment

All prices are quoted in U.S. dollars unless otherwise stated. Prices are subject to change without notice, but confirmed orders will be honored at the quoted price.

  • Prices do not include applicable sales, use, freight, duty, tariff, or other taxes and fees, which are the responsibility of the buyer.
  • Standard orders require full payment prior to shipment unless otherwise agreed in writing.
  • Trade and custom orders may require a deposit at order confirmation, with the balance due prior to shipment or upon delivery, per the terms of the individual order confirmation.
  • We accept the payment methods listed on the Site or on your order confirmation. Payment terms and accepted methods may vary for trade accounts.
  • Late payments may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law.

6. Lead Times and Fulfillment

Sukarta materials are sourced and produced in Indonesia. Estimated lead times will be provided at the time of quote or order confirmation.

  • Standard lead times typically range from six to ten (6–10) weeks from order confirmation to arrival in the United States, though actual timing may vary.
  • Lead times are estimates only. Sukarta is not responsible for delays caused by production, freight, customs, weather, or other factors outside our reasonable control.
  • We will use commercially reasonable efforts to notify you of significant delays.

7. Shipping, Freight, and Risk of Loss

  • Shipping method, carrier, and destination terms will be specified on the order confirmation.
  • Unless otherwise stated, title and risk of loss pass to the buyer upon delivery to the shipping address specified in the order.
  • The buyer is responsible for arranging on-site receipt, unloading equipment, and access as required by the freight carrier.
  • Any additional charges arising from failed delivery, redelivery, storage, or restricted access are the responsibility of the buyer.

8. Inspection and Damage Claims

Buyer is responsible for inspecting all shipments upon delivery.

  • Any visible damage must be noted on the freight carrier’s delivery receipt at the time of delivery and photographed.
  • Concealed damage claims must be reported to Sukarta in writing within seven (7) calendar days of delivery, with photographs of the damaged materials and packaging.
  • Failure to report damage within the required timeframe waives the buyer’s right to claim against Sukarta for such damage.
  • Sukarta will work with the buyer and freight carrier in good faith to resolve documented damage claims, but is not liable for damage caused during freight transit once title has passed.

9. Returns and Cancellations

  • Standard orders may be returned within thirty (30) days of delivery, unopened, uninstalled, and in original packaging, subject to a restocking fee of up to twenty-five percent (25%) and return freight paid by the buyer.
  • Custom orders, made-to-order products, cut-to-size orders, and installed materials are non-returnable and non-refundable.
  • Sample kits are non-returnable.
  • Cancellations must be requested in writing. Orders that have entered production may not be cancelled or may be subject to cancellation fees at Sukarta’s discretion.

10. Installation

Sukarta supplies material only. We do not install and are not responsible for installation.

  • Installation must be performed by qualified professionals following industry best practices for natural stone.
  • The buyer is responsible for verifying the suitability of the material for its intended application, including substrate preparation, adhesive selection, grout, sealant, and site conditions.
  • Sukarta is not responsible for damage, defects, or failures resulting from improper installation, inadequate substrate, incorrect adhesive or sealant selection, use in unsuitable applications, or failure to follow published care and maintenance guidance.
  • Once installed, the material is deemed accepted and any claim for appearance-related issues (color, tone, texture, veining) is waived.

11. Warranties and Disclaimers

Sukarta warrants that its products, at the time of delivery, will substantially conform to the material specifications provided at the time of order confirmation, subject to the natural variation described in Section 2.

THIS LIMITED WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY SUKARTA. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, ARE HEREBY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Sukarta does not warrant that any material will perform to any specific standard once installed, or that natural stone will remain unchanged in appearance over time. Natural stone develops patina, may change tone with exposure to sun, water, and use, and may require periodic sealing and maintenance as described in the applicable care guide.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SUKARTA, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, THE SERVICES, OR ANY SUKARTA PRODUCTS, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, LOSS OF USE, OR CONSTRUCTION DELAYS, EVEN IF SUKARTA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SUKARTA’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE PRODUCTS SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY THE BUYER FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

13. Trade Accounts and Professional Terms

Sukarta offers a trade program for qualified architects, interior designers, developers, builders, and stone distributors.

  • Trade accounts are subject to approval by Sukarta and may require documentation of professional credentials or business status.
  • Trade pricing, terms, and access to samples and specification packets are governed by separate trade program terms, which are made available upon account approval.
  • Sukarta reserves the right to modify, suspend, or terminate any trade account at its sole discretion.

14. Intellectual Property

All content on the Site — including but not limited to text, photographs, product names, collection names, illustrations, video, graphics, and the Sukarta name and logo — is the property of Sukarta or its licensors and is protected by copyright, trademark, and other applicable intellectual property laws.

  • No content may be reproduced, distributed, modified, or used in any commercial or promotional manner without the prior written consent of Sukarta.
  • Trade partners and clients may reference completed installations of Sukarta materials in their own portfolios, provided that Sukarta materials are credited as such where the material is identified.
  • Sukarta may, at its discretion, use photographs of completed installations for marketing purposes, with reasonable attention to client privacy.

15. User Submissions and Communications

By submitting an inquiry, project detail, image, or other communication to Sukarta through the Site, email, or any other channel, you grant Sukarta a limited, non-exclusive license to use, review, and respond to that submission for the purposes of providing the Services.

You represent that you have the right to share any content or information you submit, and that such submissions do not violate any third party’s rights.

16. Third-Party Services

Sukarta shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, epidemic, pandemic, government action, freight or port disruption, customs delays, labor disputes, or supplier failures.

18. Governing Law and Dispute Resolution
